The Alabama fan who admitted to placing his privates on a passed-out LSU fan last January learned his sentence this morning. He will get two years in prison.

He’s known to most people as the ‘Bama Teabagger, but his name is Brian Downing and he’s 33 years old.

It was video shot on a cell phone camera that got him into trouble after Alabama beat LSU in the BCS Championship game in the Superdome last January. Downing was videoed in the dining area of Krystal Burger on Bourbon Street exposing his private parts and pressing them against the neck of a passed-out Tigers fan.

The video quickly went viral and Downing quickly found himself indicted on the very serious charge of sexual battery. His attorney cut a plea deal with prosecutors, however, and last month Downing admitted to the two lesser charges of obscenity.

His attorney said the plea deal would give Downing two years in prison, but that he would not have to register as a sex offender.

Judge Karen Herman official pronounced that sentence Thursday morning, but not before scolding Downing, saying, “You put aside someone’s dignity and chose to perform a prank. He didn’t have the option to say ‘no.’ It was stupid. There’s no excuse. You’re an adult.”

In court Thursday with his wife next to him, Downing learned he will spend the next 24 months in the custody of the Louisiana Department Corrections.

Brian Downing, the Alabama fan accused of “tea-bagging” an LSU fan at Krystal Burger in the French Quarter this past January, has withdrawn a plea of not guilty and entered a guilty plea for obscenity.

Because Downing pled guilty, the charges were reduced from sexual battery and obscenity to two charges of obscenity.

New Orleans Police have arrested 32-year-old Brian Downing, charging him with sexual battery and obscenity after he identified himself as the Alabama fan seen “teabagging” a passed out LSU fan at the Krystal Burger on Bourbon Street after the BCS Championship game.

At around 10 p.m. Thursday, Downing – who is from Smiths Station, Alabama and was urged by his cousin, a Sheriff in Russell County, Alabama to turn himself into police – arrived in New Orleans and met with police and his attorney.

NOPD sex crimes detectives obtained a warrant for Downing’s arrest after they were alerted to the video and began an investigation on Sunday, January 15, one week after the BCS game.

The video shows Downing inside the restaurant exposing himself, then putting his genitals on an LSU fan who appears to be unconscious.

UPDATE: The man featured on cellphone video inside the Bourbon Street Krystal burger and wanted as a person of interest in a sexual battery of a passed out LSU fan could be Brian Downing, according to Russell County, Alabama Sheriff Heath Taylor.

As of 3 p.m. Thursday, Sheriff Taylor says Downing is currently en route to New Orleans with his family and attorney to meet with New Orleans Police sex crimes investigators. The Sheriff says he ordered Downing to travel to New Orleans immediately upon learning of his appearance in a viral video which features a man putting his genitals on the neck of a sleeping man in LSU attire at the crowded Bourbon Street restaurant presumably after the BCS Championship game between Alabama and LSU in the Dome January 9th.

Sheriff Taylor also says Downing is his 2nd cousin.

Wednesday, the NOPD said they were seeking a person of interest in the sex assault.
