The State Attorney listed the following reasons why no criminal charges should be filed in this case:

It is a one on one allegation.

It is a delayed disclosure.

The subject has made no admissions to this allegation.

No physical evidence.

Inconsistent statements made by the victim regarding her knowledge of the people she was with the night/morning of the incident as well as her description of the sex act itself.

No corroborating witnesses, despite the detective’s best efforts to locate the people the victim said were present the night/morning of this incident.

Other: Although it is understandable why the victim came forward about this allegation at the time she did, a defense attorney may seek to undermine her credibility by arguing that she merely came forward because of the news reports regarding this subject, not because the incident she alleged occurred actually occurred.

NEW ORLEANS, (WGNO) – Ex-Saints player Darren Sharper will remain in a Los Angeles jail without bail pending the receipt of charges from New Orleans.

The ruling came down Monday in California.  An arraignment has been set for Friday.

Sharper, 38, turned himself in to police last week after an arrest warrant was issued for aggravated rape of two women in an alleged incident in New Orleans in September 2013.

Sharper had been staying in Los Angeles under a severe set of restrictions set by a judge after he was indicted there on two counts of rape and additional counts of drugging the victims and others.

On Saturday, Sharper, who had been suspended from his job as an analyst for the NFL Network, was fired.

They’re accused of sexually assaulting two women in New Orleans last September.

An attorney for Sharper has not publicly commented on the arrest warrant.

US-CRIME-SHARPER An arrest warrant has been issued for former New Orleans Saints player Darren Sharper.

The allegations of rape surfaced last year.

WGNO News Reporter Darian Trotter reports a second man has also been accused in the New Orleans case.

Former Saints star Darren Sharper has suffered another devastating blow, in the string of criminal allegations against him.

New Orleans Police announced Thursday that they have an arrest warrant for Sharper.

The 38-year old is accused of raping two women at a Central Business District apartment last fall after a night of drinking at a New Orleans area bar.

“He’s not indicted or anything,” sports fan Doron Brown said. “It’s just ashamed I feel bad, it’s just a bad situation for him.”

Investigators say not one, but two women were allegedly sexually assaulted by the 14-year NFL veteran; inside the same apartment the night of September 23rd.

And they weren’t alone.

An arrest warrant has also been issued for Erik Nunez.

New information alleges Sharper’s 26-year old acquaintance also allegedly raped both women the same night, and at the same location.

Trotter asked sports fan Myer Stabinsky, “Are you at all surprised? I’m very surprised,” he replied.

“I think when you make the salary of a professional football player it’s very easy to claim rape later on,” sports fan Keith Nunez said.

The arrest warrants are the first major developments in the New Orleans allegations that are coupled with others from several cities.

Each claim follows a pattern of alleged drugging, followed by sexual misconduct.

Sharper was arrested and pleaded not guilty to charges in Los Angeles, and there are criminal cases pending in Las Vegas and Tempe, Arizona.

The string of allegations no doubt tarnishes the legacy of the player who helped lead the Saints to Super Bowl victory.

“He had a great career, now that this is going on it’s taking over basically washing out everything that he did,” Brown said.

An attorney for Sharper has not publicly commented on the arrest warrant, late Thursday.

Both Sharper and Nunez are wanted on two counts of aggravated rape.

The investigation continues and more arrests are possible.
